Preliminary building permit
Service description
In accordance with Section 76 of the State Building Code (LBO), a preliminary decision on individual issues relating to a building project can be issued upon application.
The main purpose of the preliminary decision procedure is to check the planned building project for its admissibility under building planning law before a building application is submitted.
This is particularly relevant if, for example, the project involves an undeveloped plot on the outskirts of a town or if, for example, a commercial enterprise is to be opened in a residential area.In addition, the permissibility of the project according to other legal regulations, e.g. nature conservation, water protection, soil protection, monument protection, etc., can also be the subject of the preliminary building enquiry. can also be the subject of the preliminary building enquiry. Furthermore, the preliminary decision procedure can also be used to obtain an exemption from the provisions of the development plan (e.g. change to the roof shape, exceeding the buildable plot area, etc.) required for the planned building project.
With the preliminary decision, individual questions are answered in advance by the building supervisory authority in a legally binding manner. A preliminary decision is an appealable decision that is valid for three years.
Fees are charged for the issue of a preliminary licence.
Which documents are required?
The following documents must be submitted in at least triplicate for the application:
- Application form for the granting of a preliminary decision
- Form Description of building plot
You can download and complete these documents from the Ministry of the Interior, Building and Sport.
- If a development plan exists, an extract from the development plan must be submitted (this can be obtained from the building authority of the respective municipality/city)
- The planned construction project must be drawn on a site plan and dimensioned accordingly
Official site plan (cadastral map), not older than 3 months; you can apply for this at the State Office for Surveying and Geoinformation / SAPOS.
