Maintenance collection in accordance with the Second Book of the German Social Code (SGB II)
Service description
In accordance with § 33 Para. 1 SGB II, the maintenance claim of the person entitled to benefits for the period for which benefits are paid is transferred by law to the provider of benefits in accordance with SGB II up to the amount of the expenses paid together with the maintenance claim under the law on information. This also applies if children have not received any benefits, taking into account child benefit in accordance with § 11 Paragraph 1 Sentence 4, and no or lower benefits would have been paid to the members of the household if the other person had paid benefits in good time. On the part of the Recourse Department, it is possible to claim maintenance in the following case constellations:
- Child maintenance with regard to underage and adult children (pursuant to §§1601 et seq. BGB
- Separation maintenance (spouses living apart) pursuant to §§ 1360 ff. BGB
- Post-marital maintenance (divorced spouses) pursuant to §§ 1569 ff. BGB
- Maintenance claim of father and mother on the occasion of the birth pursuant to § 1615 l BGB
