Official guardianships
Service description
The guardianship of minors includes their legal representation. The tasks can be completely different and unpredictable in individual cases. A distinction is made between statutory and appointed guardianship.
Guardianship by the youth welfare office, for example, comes into effect by law,- at the birth of the child of a minor mother or
- if the parents have consented to the adoption of their child
(Section 1751 BGB), but the adoption has not yet been pronounced by a court order.
In other cases, guardianship can be ordered by the court (appointed guardianship).
As a rule, guardianship is only transferred to the district youth welfare office if no relatives or other individuals are available.
The youth welfare office offers counselling and support to people who have been appointed guardians by the court.
